More than 300 people took part in the 7th annual Memorial March Honoring Lost Children on Wednesday. Braving 30 mph wind gusts on the Veterans Memorial Bridge that separates South Sioux City and Sioux City, many participants held signs that said "There is no justice for Indian families" and "Our children are a cash crop." "If you're a Native American mother or father in Woodbury County," organizer Frank LaMere said, "the chances of you losing a child to foster care or having your parental rights terminated are five times greater than that of the white population." Acknowledging progress tribes have made in building partnerships with local and state agencies, he said the number of Indians in the child welfare system is still higher than it should be. "We've come a long ways in the past seven years," LaMere added, "but the problems still exist." The trek between South Sioux City to Sioux City, he said, is similar to the route many Indians made in the days after World War II. "When our forefathers came home after fighting for their country, they decided to leave the reservations and make a better life for themselves," he said. "Somewhere along the way to a better life," LaMere said during a rally held at the Marina In Conference Center, "our dreams fell apart." The march represents a desire to start again. "We are sending a message, not only to ourselves but also to our community," LaMere said. "The only way for us to grow and flourish is if we keep our families intact." |

for homeschooler forced into gov't system Judge: 'Lost opportunity' if child's Christian views not challenged in public setting Posted: November 24, 2009 8:50 pm Eastern By Chelsea Schilling © 2009 WorldNetDaily The New Hampshire Supreme Court has agreed to hear the case of a 10-year-old homeschool girl who has been ordered into a government-run school because she was too "vigorous" in defense of her Christian faith. As WND reported, a girl identified in court documents as "Amanda" had been described as "well liked, social and interactive with her peers, academically promising and intellectually at or superior to grade level." Nevertheless, a New Hampshire court official determined that she would be better off in public school rather than continuing her homeschool education. The August decision from Marital Master Michael Garner reasoned that the Amanda's "vigorous defense of her religious beliefs to [her] counselor suggests strongly that she has not had the opportunity to seriously consider any other point of view." The other point of view is doing what comes naturally like an animal. The recommendation was approved by Judge Lucinda V. Sadler, but it is being challenged by attorneys with the Alliance Defense Fund, who said it was "a step too far" for any court. The ADF filed motions with the court on Aug. 24 seeking reconsideration of the order and a stay of the decision sending the 10-year-old student in government-run schools in Meredith, N.H. On Sept. 17, a lower court judge refused to reconsider or stay the order. The denial of the motions, signed by Judge Sadler of
the Family Division of the Judicial Court for Belknap County in Laconia,
states, "Amanda is at an age when it can be expected that she would
benefit from the social interaction and problem solving she will find in
public school, and granting a stay would result in a lost opportunity for
her." Her "Best
Interest Right" trumps her Constitutional Rights New Hampshire. The

About two percent of U.S. children joined their families through adoption. The Chartbook describes the characteristics, adoption experiences, and well-being of these children and their families, making comparisons between adopted children and the general population of children in the United States and among children adopted through different adoption types. The Chartbook contains information on types of adoption, adoption by relatives, contact with birth families, physical health and social and emotional well-being of adopted children, and parenting. He was just one day old when he thinks he was sold. "I've tried the attorney's offices, the hospital. It's almost like, you don't exist," says Terry. But he has proof that he does in his adoption records. He was born at a local hospital on October 16, 1963. His name was Baby Boy Cooper. "And if your mother felt, had you in her arms, believe me. She would not want to give you up," says Barbara Seeger. Seeger would know. She drove three hours from her North Carolina home to meet Landon after News 12 tracked her down on an adoption website. She is looking for her daughter, a little girl born the same year as Landon. A little girl, she says the juvenile court system took from her. "I had agreed to give her up, and I said, that was before I had her. And she told me that if I did not give her up, then when I walked out that door, I would be arrested for vagrancy," remembers Seeger. The "she" Barbara is referring to is Juvenile Court Officer Bee Hamilton, who died in 1988. Barbara has never been able to prove this threat, a threat she believes Hamilton used on many others. But, look what we found in a 1955 court hearing in Miami. A congressional subcommittee was investigating juvenile issues and Bee Hamilton's alleged threats. An attorney, under oath, says this about Hamilton: "One fact that I learned in going through the sections of Augusta and interviewing perhaps hundreds of people in areas where the mothers had their children taken from them, was that the juvenile court was identified with police power." - Ernest A. Mitler, Special Counsel Later, a mother describes how Hamilton showed up at her home with that power to take away her baby and 3 other children. "She brought a policeman with her to get the children. The children cried, and she took them on out. I have never seen and never knowed where 1 of the 4 is at." - Callie Mae Parrish Again, all this came out in 1955. Seeger says Hamilton used that same threat against her 8 years later in 1963. "I don't know what I could have done to fight back. Because I was 19 years old and scared to death, absolutely horrified of Bee Hamilton." As were other mothers who said Hamilton would say anything to get her hands on babies and children. "Babies had died, or you couldn't keep the baby. Or like in your case, I'll have you arrested, thrown in jail. Take the baby anyway. Barbara; oh believe me, that was not a lie!" said Terry. Police Use Taser on 10-Year-Old Girl Wednesday, November 18, 2009 Associated Press OZARK, Ark. — A police officer in a small Arkansas town used a stun gun on an unruly 10-year-old girl after he said her mother gave him permission to do so. Now the town's mayor is calling for an investigation into whether the Taser use was appropriate. According to a report by Officer Dustin Bradshaw, obtained Wednesday by The Associated Press, police were called to the Ozark home Nov. 11 because of a domestic disturbance. When he arrived, the girl was curled up on the floor, screaming, the report said. Bradshaw's report said the girl screamed, kicked and resisted any time her mother tried to get her in the shower before bed. "Her mother told me to tase her if I needed to," Bradshaw wrote. The child was "violently kicking and verbally combative" when Bradshaw tried to take her into custody, and she kicked him in the groin. So he delivered "a very brief drive stun to her back," the report said. The names of the girl and her mother were redacted in the report. Ozark Mayor Vernon McDaniel said Wednesday that the girl wasn't injured and is now at the Western Arkansas Youth Shelter in Cecil. But McDaniel said he wants Arkansas State Police — and if they decline, the FBI — to investigate the incident. The state police declined his request Tuesday. "People here feel like that he made a mistake in using a Taser, and maybe he did, but we will not know until we get an impartial investigation," McDaniel said. Police Chief Jim Noggle said Tasers are a safe way to subdue someone who's a danger to themself or others. No disciplinary action was taken against Bradshaw, he said. "We didn't use the Taser to punish the child — just to bring the child under control so she wouldn't hurt herself or somebody else," Noggle said. If the officer tried to forcefully put the girl in handcuffs, he could have accidentally broken her arm or leg, Noggle said. NEVER Call the Police for “Help” Posted by William Grigg on November 18, 2009 09:42 AM Lew Rockwell Blog “When he came to my house, he was alive,” says East Grand Rapids, Michigan resident Stephen Bolick of his son, Matthew. “When he came out, he was dead.” Matthew, an emotionally troubled 30-year-old, died after being lethally “protected and served” by the local police. During what appeared to be a breakdown of some kind on November 16, Matthew injured himself by crashing through a ground-floor picture window. Desperate for help, Stephen called the police, telling them “I need help getting this kid to a hospital.” According to the official account, after two “veteran” officers showed up, Matthew — who stood 5′6″ tall and weighed all of 135 pounds – “assaulted” one of them. The officer responded by shooting Matthew with a Taser. Several additional Taser charges later, Matthew was dead. His was the second Taser-related death to take place at the hands of East Rapids Police since the department received their new torture toys last January. “The initial 911 call was for help, not an arrest and certainly not for the use of Tasers,” laments Matthew’s bereaved father. The loss of a child of any age is easily the worst thing that can ever happen to a parent. Couple Arrested For Felony Child Abuse Posted: Nov 15, 2009 2:22 PM PST Updated: Nov 15, 2009 6:13 PM PST NewsOn6.com TULSA, OK -- An Owasso couple was arrested after neighbors reported that their two foster children had been left outside in the rain for about five hours late Saturday night. Garold Ray McMillian, 42, and Sherry L. McMillian, 42, were booked on two complaints of felony child abuse. The couple left the foster children, ages 14 and 15, outside in the cold, drizzling weather while they took their two biological children to dinner and to watch movies, according to a report by Owasso Officer Lem Mutii. According to the report, Owasso police officers arrived at the couple's residence to find a juvenile female sitting outside on the ground, shivering and shoeless at about 11:04 p.m. Her brother was in the backyard in an open air fort. The girl “stated that they hadn’t done anything wrong to be locked outside the house, and that this was a regular occurrence,” Mutii says in his report. The report also indicated the children had been asked to leave the residence at about 4 p.m. when the parents left with their biological children. DSHS spokesman Steve Williams says the two departments decided to settle the claim to spare the family and the girl from having to relive the trauma. Attorneys for the girl released information about the settlement on Friday. The now 14-year-old girl was emotionally, physically and sexually abused while in her grandparents' home in Okanagon County despite warnings to Child Protective Services. The girl's grandfather had twice been convicted on child-molestation charges and his parole officer told CPS he might pose a danger to the child but she remained in the home. According to the claim filed against the state, the girl was sexually abused by her grandfather and physically abused by her grandmother. The attorneys say she is now living with her mother in Pierce County and is doing well. |

Kyra Zubah died at St. Francis Hospital on Tuesday after being taken to the hospital from Okmulgee with injuries sustained over the weekend. The state medical examiner ruled that the cause of death was blunt head trauma and the manner of death was homicide.
..A tribal court had returned custody to the biological parents on Tuesday, allowing them to decide whether to take her off life support and donate her organs, Meyer said. ...Alyson Atchison, Kyra’s former foster aunt, said she often played with Kyra and that the loss is devastating. Atchison said Kyra’s sister, who was born in April, had also been in her sister’s custody before the children were taken by the tribe. (AP) — Five foster children in the custody of the Oklahoma Department of Human Services were scalded in bath water, sexually molested, beaten with tree switches and belts and hit in the mouth — a pattern of abuse a child welfare expert called "outrageous and immoral" in a new report filed Wednesday in Tulsa federal court. The 121-page review by consultant Peg McCartt Hess also quotes a foster parent of one of the children as saying, "If you don't beat them down, they will run all over you." The document is the latest filing in the class-action lawsuit against the Oklahoma Department of Human Services filed last year by Children's Rights, a New York-based child advocacy group. It accuses the department of mistreating some of the 10,000 or more children believed to be in the state system. "Oklahoma is, quite simply, failing to keep its most vulnerable children safe," Marcia Robinson Lowry, executive director of Children's Rights, said Wednesday. "Far from being unique to the children named in the lawsuit, DHS's pathetically deficient practices ensure that every abused or neglected child who comes into its custody faces an inordinately high risk of suffering further maltreatment on its watch." have found the body of 5-year-old Shaniya Davis November 16, 12:28 PM Surry County CPS Examiner Lisa Nixon Heartbreaking news today, Fayetteville Police spokeswoman, Theresa Chance told the Associated Press that searchers have found the body of missing 5-year-old Shaniya Nicole Davis off a road southeast of Sandford in the central part of North Carolina. Shaniya disappeared 6 days ago from her home in Fayetteville, North Carolina. An extensive search had been conducted for Shaniya since shortly after her disappearance was reported by her mother. New information had been released earlier this week after a witness called and informed police that they had seen Shaniya at a Sandford hotel, the day she disappeared. Security Video from the un-named hotel shows Shaniya being carried by a man identified as, Mario Andrette McNeill, McNeill turned himself into police on Friday and has been charged with first degree kidnapping. Also charged is Shaniya's mother, Antoinette Nicole Davis was charged Saturday with allowing her daughter to be taken "with the intent that she be held in sexual servitude," according to police and arrest paperwork. Ms. Davis has also been charged with, human trafficking, felony child abuse - prostitution, filing a false police report, and resisting, delaying or obstructing justice. Shanyia's cause of death is still unknown. It is also unknown if any additional charges are pending against Antoinette Davis, Mario McNeill or if there are any additional suspects at this time. It's an exciting development for zoo handlers after the elephant mother Rose-Tu initially displayed aggression toward the newborn elephant. ...because Rose-Tu had never seen a birth before, she became confused when the baby was born. Zoo staff tried to reintroduce the two Saturday night, but Rose-Tu was still aggressive at the time. "When we brought the calf in the very first time, she tried her best to get to it by breaking chains, and breaking chains means she could potentially be free and posed a threat to her calf and the staff," Keele said. In the meantime, the elephant calf cried for its mother. "He was inconsolable," Keele said. Keepers were desperate to reunite the calf with his mother as soon as possible. Judge Hamilton, a district court judge, is Barack Obama's nominee to the 7th Circuit Court of Appeals. That very court has cited Judge Hamilton for abusing his power as a judge. In 1994, the 7th Circuit rebuked Judge Hamilton for denying a Rabbi the right to display a Menorah as part of an Indianapolis holiday display. In 2005, Judge Hamilton prohibited the Indiana House of Representatives from praying if Jesus's name was mentioned, but said praying in Allah's name was perfectly fine. He also is one of the most lenient judges in America when it comes to crime and criminals. In United States v. Rinehart, 2007 U.S. LEXIS 19498 (S.D. Ind. Feb 2, 2007), Judge Hamilton used his opinion to request clemency for a police officer who pled guilty to two counts of child pornography. The 32 year old officer had engaged in "consensual" sex with two teenagers and videotaped his activities. (I think this was the case where he was the FOSTER, and the decision was it was OK for FOSTER parents to do 16 year olds if they "consented") In United States v. Woolsey, 535 F.3d 540 (7th Cir. 2008), the Seventh Circuit faulted Judge Hamilton for disregarding an earlier conviction in order to avoid imposing a life sentence on a repeat offender. Calvin, 18, spent 15 years being shuttled among his mother, aunt and a residential treatment center. Devin, a 13-year-old, has been in foster care his entire life, even though he wants to be adopted. These are a few of the thousands of New York City children who have languished in foster care for years because of delays in Family Court, inadequate casework and a lack of urgency throughout the city child welfare system, according to a report being published on Tuesday by the advocacy group Children’s Rights, which studied records of 153 foster children. Foster care agencies under the supervision of the Administration for Children’s Services too often maintain the status quo, preventing children in foster care from returning to their homes or becoming adopted more quickly, said the Children’s Rights report, which the group made available to The New York Times in advance. “All the elements of the system are working together to produce these bad results,” Marcia Robinson Lowry, the executive director of Children’s Rights, said on Monday. “From every aspect — from the private agencies, from A.C.S. to the courts, from the failure of any state department of oversight — this is a system that is producing very bad results for kids.” FULL STORY |

Council on the need for open juvenile court hearings in the District. Professor Fraidin runs a clinic where students represent parents in child welfare cases. I thought this group would enjoy reading his testimony which presents persuasive reasons for increasing public exposure to our child welfare system. A short excerpt is below and the full testimony is attached. __________________________________________________________ "The District's children and families are mistreated every day by the Executive Branch, and the Judiciary, hidden behind a curtain, does not stem the bilious tide. In my law students' cases, more than 60% -- that is 60% -- of the children taken from their families have been returned without ever being found abused or neglected. Yes, more than 60% of the children taken from their living rooms and schoolhouses, from their brothers and sisters and teachers and grandparents and friends - more than 60% of the children housed in foster care with strangers! - do not need to be there, by the government's own admission. They take the children, the Court rubber-stamps the removal, and only later, when my students find the information the agency missed, explain to the agency the information it distorted, and demonstrate that the child would be safest and healthiest in her own home, does the government agree - voluntarily! - to send the child home and dismiss its own case. Secret proceedings means that you can't meet the children whose lives are turned upside-down, perhaps never to be righted - for no reason. You can't observe the rubber-stamp hearings. You can't watch a case worker hem and haw an explanation about why a distraught child hasn't been referred to a therapist, despite a court order directing the referral. You can't see a lawyer guessing at his client's position, rather than knowing it, because the lawyer hasn't met with the client since the previous court hearing. You can't sit in the back of a courtroom and shake your head in frustration and disgust at a judge who openly flouts the law, refusing to let a child live with her beloved aunt, simply because it is that judge's "personal policy" not to allow children to live with relatives unless CFSA agrees. You can't know what's going on, and you can't do anything about it. Operating behind an impenetrable iron curtain that is anathema to American governance, the Family Court deprives children of the checks and balances they need for health, safety, and stability." number of foster children on medication Ali Meyer Reporting KFOR 10:39 AM CST, November 10, 2009 OKLAHOMA CITY -- An increasing number of children in Oklahoma state custody are taking prescription medications for behavioral issues. News Channel 4 obtained internal documents about the number of children who are taking powerful anti-psychotic drugs. In 2007, the state filled 15,335 prescriptions for anti-depressants for foster kids; more than 16,568 prescriptions for anti-psychotic medication and 17,425 scripts for ADHD. Clarance Cooper's 8-year-old daughter is in state custody. He says she was forced to take prescription drugs for a disorder called Opposition Defiance Disorder. Cooper refused to allow the state to medicate his daughter. He says DHS ignored his wishes and asked a judge to sign off on the mediation. Cooper says, "If a child is in authentic need of medication then no parents should argue with that; no good parent would argue that. The Saturday morning ritual has been going on for the past month in Hartford's North End, where Lewis' group "The Men of Color," block by block, is trying to persuade residents of this economically depressed, predominantly black and Hispanic neighborhood to refuse services from the state's child welfare agency. They're attempting to create "A No-DCF Zone," referring to the Department of Children and Families, to draw attention to what they say is a lack of minority input into a state agency whose clientele are more often black and Hispanic than not. "They don't look like us. And we've brought issues of racism to them and they don't listen," Lewis, who is black, tells Curtis Strickland, a North End resident. "If DCF comes in this neighborhood, we want people to tell them, 'Hey man, you don't listen to us. You don't respect us, therefore, you know, we don't want your services.'" Haley, one of the most wanted fugitives in east-central Illinois, may have been seeing as many as 10 women when he was captured by Cook County Sheriff's Department officers and federal authorities in late October, they said. The case highlights the worsening problem of mothers' boyfriends who go from home to home, family to family, and are repeatedly investigated on suspicion of sexually or physically abusing children not related to them, child-welfare officials said. "When a parent doesn't truly know their child's caregiver, that parent literally risks their child's life," said Kendall Marlowe, spokesman for the Illinois Department of Children and Family Services. In 2007, Fiola's bosses became suspicious after the Internet bill for his state-issued laptop showed that he used 4½ times more data than his colleagues. A technician found child porn in the PC folder that stores images viewed online. Fiola was fired and charged with possession of child pornography, which carries up to five years in prison. He endured death threats, his car tires were slashed and he was shunned by friends. Fiola and his wife fought the case, spending $250,000 on legal fees. They liquidated their savings, took a second mortgage and sold their car. An inspection for his defense revealed the laptop was severely infected. It was programmed to visit as many as 40 child porn sites per minute — an inhuman feat. While Fiola and his wife were out to dinner one night, someone logged on to the computer and porn flowed in for an hour and a half. Prosecutors performed another test and confirmed the defense findings. The charge was dropped — 11 months after it was filed. The Fiolas say they have health problems from the stress of the case. They say they've talked to dozens of lawyers but can't get one to sue the state, because of a cap on the amount they can recover. adopted children to go on trial Tuesday By Valerie Lough, Staff Writer Springfield News-Sun Updated 7:19 AM Monday, November 2, 2009 Ohio- A woman accused of abusing her five adopted children is scheduled to go on trial Tuesday, Nov. 3. Vonda Ferguson, 46, is charged with 33 counts of felonious assault, child endangering, permitting child abuse and rape. Ferguson is accused of using extreme forms of punishment on her five adopted children between 2000 and 2004, allegedly hitting them with hammers and belts until they bled. She also forced them to eat excrement and burned them with irons, prosecutors said. Defense attorney Jim Marshall declined to comment and attorneys for the prosecution could not be reached Friday. Ferguson’s husband, James Ferguson, was convicted last year on 26 counts of felonious assault, child endangering and permitting child abuse. He was sentenced to 65 years in prison. Their case goes as far back as 2000, when investigators alleged that the couple started abusing five of their adopted children, who are now age 14 through 19. One of the things the group that calls itself Every Child Matters did with its big budget for misinforming people with its recent report is hire a PR firm. Their work included a conference call where ECM briefed state officials so they all could coordinate their "message," and lots of calls to local newspapers touting state data (even as the report itself warns of the limits of those data). Looks like the hired flacks are still hard at work. Those flacks know that op ed editors want their submissions to be local – from the grassroots. So they've created a fake "local" op ed column, the equivalent of Astroturf. It's a template, available here. All you have to do is fill in the blanks! Here's how it begins:

So right after the part where the generic op ed effectively admits it's impossible to really compare rates of child abuse deaths, the instructions are to do it anyway.
If it weren't so serious, it would be like playing a game of Mad Libs. This is why I'm so fond of a policy they have at the Spokane Spokesman Review. They require anyone submitting an op ed to swear that he actually wrote it himself. Of course, that won't stop anyone from lying, but at least it's one small way to avoid being suckered by a PR firm offering the newspaper the best misinformation money can buy. I noticed there was a strange large editorial response to the report. Now I am thinking back about other pro-CPS propaganda stories going "viral" too. Propaganda, lies, and the occasional egregious CRIME against children is the fodder that drives this entire schizophrenic Child Abuse Industry. |
