Foster kids suffer 'high' rate of abuse, neglect  
Federal monitors found that 25 of the 2,348 children in those two systems were abused or neglected

Georgia- (AP) -- Federal monitors say foster children in Fulton and DeKalb counties experience a "high" rate of abuse and neglect while in state care.

The Atlanta Journal-Constitution writes that federal monitors found that in the first six months of last year 25 of the 2,348 children in those two systems were abused or neglected while in state care.  The report says the systems have "no higher obligation" than to ensure these children's safety.  The systems are overseen by the state Division of Family and Children Services.

Independent monitors were appointed by a federal judge to review the performance of the systems after Georgia settled a 2005 lawsuit calling for reforms.

DFCS spokeswoman Dena Smith says the agency has added staff and resources and should see improvement in the next report.

If they started hiring the people they have run through their ungodly meatgrinder, there would be some MASSIVE improvement in the system.  But as long as the system is operated by communist morons, there will never be anything but death and destruction to families.

I'm finding it ever more difficult to describe to people the kind of world that the Mises Institute would like to see, with the type of political order that Mises and the entire classical-liberal tradition believed would be most beneficial for mankind.

It would appear that the more liberty we lose, the less people are able to imagine how liberty might work. It is a fascinating thing to behold.
  • People can no longer imagine a world in which we could be secure without massive invasions of our privacy at every step, and even being strip-searched before boarding airplanes, even though private institutions manage much greater security without any invasions of human rights;
     
  • People can no longer remember how a true free market in medical care would work, even though all the problems of the current system were created by government interventions in the first place;
     
  • People imagine that we need 700 military bases around the world, and endless wars in the Middle East, for "security," though safe Switzerland doesn’t;
     
  • People think it is insane to think of life without central banks, even though they are modern inventions that have destroyed currency after currency;
     
  • Even meddlesome agencies like the Consumer Products Safety Commission or the Federal Trade Commission strike most people as absolutely essential, even though it is not they who catch the thieves and frauds, but private institutions;
     
  • The idea of privatizing roads or water supplies sounds outlandish, even though we have a long history of both;
     
  • People even wonder how anyone would be educated in the absence of public schools, as if markets themselves didn't create in America the world's most literate society in the 18th and 19th centuries.
This list could go on and on. But the problem is that the capacity to imagine freedom – the very source of life for civilization and humanity itself – is being eroded in our society and culture. Isaiah James May was born a little after 5 p.m. on Oct. 24, 2009, and was scheduled to die this past week – on Wednesday, Jan. 20 – just short of his three-month birthday.

That was the day chosen by Canada's publicly funded, government health service as the deadline for Isaiah to recover from his traumatic birth or be taken off life-support.

"There is no hope of recovery for Isaiah," reads a letter from Alberta Health Services delivered to Isaiah's parents and dated one week before the health care system intended to pull the plug on the baby it has determined irreparably brain damaged.

"Your treating physicians regretfully have come to the conclusion that withdrawal of active treatment is medically reasonable, ethically responsible and appropriate,"

Call for halt to Haiti adoptions over traffickers

Thousands of children unaccounted for since Haiti’s earthquake are at risk of falling prey to child traffickers, aid agencies have warned, as fears were raised over at least 15 children who have vanished from hospitals within the past few days.

Unicef, the UN children’s agency, warned that "traffickers fish in pools of vulnerability. We know from past experience that trafficking happens in the chaos that usually follows emergencies." A Unicef adviser, Jean Luc Legrand, said he knew of at least 15 cases of children disappearing from hospitals.

Save the Children, World Vision and the British Red Cross have called for an immediate halt to adoptions of Haitian children not approved before the earthquake, warning that child traffickers could exploit the lack of regulation. There has been a surge in offers from well-meaning foreigners.

Rupert Colville, spokesman for the UN High Commissioner for Human Rights, said that child enslavement and trafficking was "an existing problem and could easily emerge as a serious issue over the coming weeks and months".  FULL STORY

OLYMPIA, Wash. - A series of stories by the KING 5 Investigators is leading to potential changes in state law, giving relatives more rights in child welfare cases.

The "Alexis Stuth Bill" was heard before a senate sub-committee in Olympia Thursday. It stems from a three-year battle between the state and an Enumclaw couple over their granddaughter.

"I think it's huge," said AnneMarie Stuth as she and husband Doug walked into the state Capitol with little Alexis in tow. It was a family nearly broken apart forever by the system.

"We were going to lose her forever, never see her again. It was the end of the line," said Doug.

The bill would give relatives who care for a child the right to be heard in court with an attorney if the state takes the child away from them in favor of foster care -- exactly what happened in the Stuths' case.

"Family is all you have. That is the one thing that's a constant. It never changes. You always love them and they're always there and I don't think somebody should have the right to take that from anybody, especially a little one," said AnneMarie.  FULL STORY

Former Del. Judge Admits Child Sex Abuse

DOVER, Del. (AP)- Attorneys for two men who sued a Delaware judge for alleged child sexual abuse say the judge has admitted molesting one of the men.

Attorneys said Thursday that William Bradley Jr., who recently resigned from the Court of Common Pleas, signed a confession admitting that he molested Gregory Kelly in 1975.

The confession was part of a settlement reached with Kelly, whose attorney said a settlement also has been reached in a lawsuit filed by a man identified only as John Doe.

Kelly, a Nevada resident, alleged that Bradley fondled him on two occasions during overnight visits at Bradley's house. Kelly was 11 at the time.

Bradley had previously denied the allegations. His attorneys did not immediately respond to messages Wednesday night.

(NaturalNews) Drug maker Johnson & Johnson paid tens of millions of dollars in kickbacks to nursing home pharmacies in order to boost the sale of its drugs, says a Justice Department lawsuit.

The payments were often disguised as grants or "educational funding," says the lawsuit, and they were directed to Omnicare, a prominent nursing home pharmacy company.

The elaborate kickback scheme caused sales of Johnson & Johnson drugs to skyrocket. Sales of the antipsychotic drug Risperdal, for example, helped J&J drug purchases from Omnicare nearly triple from $100 million to $280 million a year.

An email released by the Justice Department shows an Omnicare executive writing:

"WE ARE SELLING MORE HIGH PRICED DRUGS (read Risperdal here) FOR THE PHARMACEUTICAL INDUSTRY!!"

Omnicare is already steeped in other accusations of fraud. The company agreed to pay the U.S. government $98 million in a settlement reached a few months ago (while admitting no guilt, of course). (http://www.cbsnews.com/stories/2009...)

Drugging the seniors
Today's nursing home patients are often treated much like prisoners, mentally shackled with chemical restraints known as pharmaceuticals. The mass-drugging of senior citizens in nursing homes has now reached criminal proportions. Rather than actually treating patients in ways that make them healthy, nursing home staff in some facilities have discovered it's much easier to just drug patients into a zombie-like state where they don't ask questions or cause trouble.

Johnson & Johnson medications are used as part of this "chemical restraint" recipe, which is actually a form of chemical abuse of senior citizens. J&J and Omnicare, of course, are far more concerned with selling medications than actually improving the quality of life for nursing home patients, so the more drugs are sold and consumed, the more "success" these companies think they have.

Even doctors are now calling the pandemic a complete hoax. Noah Kirkman faces the possibility of being permanently adopted out to strangers, despite having a mother and sister in Calgary, and at least three willing homes where the Canadian boy might be cared for by blood-relatives.

One of those relations is Noah’s mother Lisa Kirkman, and therein lies the rub: Oregon’s Department of Human Services considers Lisa such an unfit parent, they’d rather keep Noah in the foster system than let him come home.

Government to teach parents how to raise children

Australia- GOVERNMENT workers will teach Victorian parents how to raise their children under a radical overhaul of the state's child protection system.

Over 50 new social workers will be hired as part of a pilot project to fix troubled homes and help struggling parents, the Sunday Herald Sun newspaper says.

The move comes after months of controversy surrounding the state government's handling of child services.

An ombudsman's report raised serious questions about the capacity of the department of human services to protect children, detailing cases where children were living with convicted sex offenders.

In September last year, state officials admitted they knew nothing of a case in which a woman was allegedly abused by her father for 30 years until it was featured in media reports.

Community Services Minister Lisa Neville is expected to announce the details of the parenting pilot project on Sunday, the paper says.

Under the plan, newly-hired social workers will spend up to a year teaching parents basic skills such as disciplining children, making healthy meals and managing school schedules.

"They may also help parents manage the family's budget,'' Ms Neville told the Sunday Herald Sun.

"Developing schedules for a new baby, safe sleeping arrangements, how to manage a toddler or a difficult adolescent and even how to play educational games with their kids are all activities the mentors can help families with.''

The parental workers will be trained in identifying family violence, substance abuse and mental health issues as well.

As a parent advocate at a foster care agency, I work with parents to help them reunify with their children. In ten years of working with families, I’ve seen the positive and negative impact of ASFA.

For children whose parents cannot or will not change their behaviors, and who are lucky enough to find caring adoptive parents, ASFA can provide permanency, stability and a loving family. But for parents who want to reunify with their children, ASFA can either be a godsend or a nightmare.

Its short timeframe for reunification can give child welfare professionals, lawyers, judges, and parents the push to move quickly toward reunification, helping families heal. Or it can be too quick a deadline for troubled parents working with a dysfunctional system, destroying a family.>>>(more)

"The authorization for the Child Abuse Prevention and Treatment Act (CAPTA) expired 9/30/08. The 111th Congress will be considering CAPTA reauthorization in 2009.

The Senate HELP Committee staff circulated draft reauthorization language in early June 2009. The draft did not include the provision mandating appointment of a second person to provide legal representation. A letter was submitted to HELP Committee leadership on behalf of CCJ/COSCA. APHSA and NCSL also have a concern regarding a new unfunded mandate.

The legislation is on hold until health care reform legislation is resolved. The House is expected to defer action until after legislation is filed in the Senate."

Parental Rights Needs Help in Your State

It is January, and that means State legislatures are (or soon will be) gearing up again. Several of these State bodies will be considering resolutions calling on the U.S. Congress to pass the Parental Rights Amendment to the States for ratification.

A few states which will or may introduce such resolutions include California, Hawaii, Idaho, Indiana, Michigan, Oklahoma, Utah, and Virginia. ParentalRights.org stands ready to supply sample wording and other resources for any state that may wish to consider such a measure.

As a result, we would like to urge you this week to investigate your state legislature. Here’s all we’d ask you to do:

Action Item

  • Visit our States Watch page and click on your State to see if a parental rights resolution has already been introduced in your legislature. (As of this email, only Virginia and Hawaii are definites.)
  • Visit your state legislature’s website to find and write down the contact information for your state lawmakers.
  • If there is already a resolution in your state, contact your lawmakers and urge them to support that resolution for the sake of parents, families, and the rights of your particular state.
  • If there is not already a resolution in your state, contact your lawmakers and urge them to champion such a resolution. Tell them ParentalRights.org would welcome contact from them, and we would be happy to provide them with sample language from which such a resolution can be written. You might even offer to contact us on their behalf and get that information for them!
  • Remember to follow up in a couple of weeks to make sure your efforts are moving things forward. Many state legislatures won’t be convened for long, so time is of the essence.

NORMAN, OK -- Surrounded by friends and family who were wearing purple ribbons in support, Amy Holder made her way into a Logan County courtroom for her initial appearance. The Edmond woman is accused of one count of child abuse and one count of child neglect after her two-year-old foster child was found dead inside of her home in January of 2009.

....Defense attorney Scott Adams claims the child didn't die of blunt force trauma and finds it odd that investigators used an outside lab to rule the cause of death instead of the State Medical Examiners Office.

"They wanted someone to point the finger at Amy and they wouldn't do it in the state of Oklahoma," said Adams. "She did absolutely nothing wrong. She never touched this child. All she ever tried to do was care for it."

He also says the victim was already sick and claims his client alerted doctors and state officials to the problems.

"She reported to DHS on numerous occasions, dozens of occasions, that this child was sick, something was severely wrong with it; it was choking all the time, it was throwing up, it couldn't eat and they basically told her we don't have anywhere else to send her," said Adams.  FULL STORY and Video

A blue-ribbon panel that includes three former heads of the Congressional Budget Office is telling President Obama and the Democrat-controlled Congress that the federal deficit must be cut now or the national debt within about two generations will be 600 percent of the Gross Domestic Product.

"The debt level of the United States is unsustainable, something has to give," said Rudolph Penner, former head of the CBO and co-chair of a report issued last week by the National Research Council and the National Academy of Public Administration.

The report concludes federal deficit spending is so out of control that unless  Obama and Democrat leaders on the Hill make changes now, debt in 2080 will be six times what the nation produces.

The alarm is being sounded just as the Obama administration is preparing to push his nationalized health care plan through Congress. It comes from a bipartisan group of top economic policy experts including three former heads of the CBO, who warned existing entitlement programs including Medicare, Medicaid and Social Security already are creating a fiscal crisis for the nation without the addition of government-funding universal health care.  FULL STORY

Delco man jailed on truancy charges; owes $17,500

Listen up, kids. Today's lesson is: Don't skip school.

You could end up paying for it as an adult. And you might even be thrown in jail. Not a juvenile detention center, but a grown-up prison.

Keaton Fehrle, 20, could tell you all about it – whenever he gets out of the George W. Hill Correctional Facility, where he has been held since Tuesday on truancy charges he accumulated as a teenager in Delaware County.

Sure, Fehrle's old attendance record at Interboro High School makes Ferris Bueller look like a model student. But should the Essington resident be sitting in a jail cell for ditching class when he was in the 10th grade?

"It's kind of like getting detention – four years later," said his attorney, Michael Malloy. "Should he go back and scrub the blackboards again?"

Fehrle apparently racked up $17,500 worth of fines and court costs after repeatedly missing school in 2005 and 2006. He was busted for the truancy violations this week when his girlfriend was pulled over for speeding. Fehrle was a passenger in the car, and the police officer discovered that there was a warrant out for his arrest.  FULL STORY

Edmond foster mom held in death of child

EDMOND, Oklahoma — An Edmond woman was arrested Friday afternoon on a child abuse complaint in connection with the death of her 2-year-old foster child, said Oklahoma State Bureau of Investigation spokeswoman Jessica Brown.

Amy Holder, 38, was arrested in the death of the girl, identified as Naomi, who died Jan. 20, 2009, at 7751 Prairie View Road in Edmond, Brown said.

Investigators ruled the cause of death to be blunt force trauma to the head, abdomen and extremities, Brown said.

Holder was arrested by OSBI agents at the request of the Logan County district attorney’s office, Brown said.  FULL STORY

David Foley, attorney for Rozita Swinton, said Wednesday Texas authorities don't believe his client had any "criminal involvement" in telephone calls to a domestic violence hotline that triggered a raid on the Yearning For Zion Ranch in Eldorado, Texas, in April 2008. Oklahoma DHS worker charged in drug possession

PAULS VALLEY — A state child welfare worker is accused of possessing drugs near a school.

Brandi Nicole Gilley, 24, is charged in Garvin County District Court with felony possession of drugs within 1,000 feet of a school and misdemeanor possession of drug paraphernalia. Police allege they found marijuana inside her and her husband’s home on Oct. 31.

Christopher Gilley, 25, faces the same charge as his wife. They were charged Dec. 2 and were not required to post bail to stay out of jail.

Gilley, a child welfare specialist, is on paid leave pending the outcome of an investigation, said Beth Scott, a spokeswoman for the state Department of Human Services.

Scott said Gilley was assigned to Garvin County and has worked for DHS since Feb. 2008.  FULL STORY

The story of the Amiraults of Massachusetts, and of the prosecution that had turned the lives of this thriving American family to dust, was well known to the world by the year 2001. It was well known, especially, to District Attorney Martha Coakley, who had by then arrived to take a final, conspicuous, role in a case so notorious as to assure that the Amiraults' name would be known around the globe.

....Attorney General Martha Coakley—who had proven so dedicated a representative of the system that had brought the Amirault family to ruin, and who had fought so relentlessly to preserve their case—has recently expressed her view of this episode. Questioned about the Amiraults in the course of her current race for the U.S. Senate, she told reporters of her firm belief that the evidence against the Amiraults was "formidable" and that she was entirely convinced "those children were abused at day care center by the three defendants."

What does this say about her candidacy? (Ms. Coakley declined to be interviewed.) If the current attorney general of Massachusetts actually believes, as no serious citizen does, the preposterous charges that caused the Amiraults to be thrown into prison—the butcher knife rape with no blood, the public tree-tying episode, the mutilated squirrel and the rest—that is powerful testimony to the mind and capacities of this aspirant to a Senate seat. It is little short of wonderful to hear now of Ms. Coakley's concern for the rights of terror suspects at Guantanamo—her urgent call for the protection of the right to the presumption of innocence.

If the sound of ghostly laughter is heard in Massachusetts these days as this campaign rolls on, with Martha Coakley self-portrayed as the guardian of justice and civil liberties, there is good reason. FULL STORY

Those surveyed included parents with children ages three to fourteen, individuals who research children’s issues, pediatric specialists, psychology and sociology specialists, children magazine editors and NGO charity members. The report states that “Increasing child neglect cases and poverty-stricken child population, and frequent occurrence of child abuse and drug use are the three issues of the greatest concern over children.” In anticipation of the 20th anniversary of the adoption of the Convention on the Rights of the Child (CRC) by the United Nations in 1989 on November 20th, Xinhua and UNICEF have launched a global campaign for children’s rights called “Global News Day for Children.”

UIC study alleges an overuse of drugs on juveniles at understaffed Streamwood psychiatric hospital

One of Illinois' largest psychiatric hospitals dosed foster children with dangerous combinations of mood-altering drugs, sometimes using the medicines as "chemical restraints" to control youth who needed counseling, according to a sharply worded new report by the University of Illinois at Chicago's department of psychiatry.

The northwest suburban Streamwood Behavioral Health Center, which has treated roughly 475 Department of Children and Family Services wards since 2007, is "so understaffed as to be counter-therapeutic," the UIC report said. Amid violent outbursts by young patients, hospital staff resorted to extraordinarily high rates of emergency psychiatric medications, physical restraints and seclusion, the report said.

DCFS Director Erwin McEwen reacted to the findings by angrily criticizing Streamwood owner Psychiatric Solutions Inc., the nation's largest for-profit behavioral health firm.

"Profiteering at the expense of the mental health of vulnerable children will not be tolerated in Illinois," McEwen's statement said.  Wouldn't it be great if he actually meant that?  FULL STORY

Warnings about accused Del. pediatrician surface

DOVER, Del. – Dating back almost a decade, there were complaints and investigations involving Dr. Earl Bradley, a well-known Delaware pediatrician who authorities say may have molested more than 100 children.

There were jokes among colleagues, who thought Bradley had an unusual practice with his carnival-like office filled with toys and a merry-go-round. Even Bradley's own sister, who worked for him, heard parents' concerns.

Despite the warnings, Delaware's medical board only recently suspended Bradley's license — after he was arrested.

"The system failed. What I don't know, and what we must find out, is where and how," said Gov. Jack Markell, who plans to order an independent review of the state's handling of the case.

Outraged parents have complained that children could have been spared had officials acted sooner.

"If he was under investigation for over a year, why didn't someone speak up?" a tearful mother said at a community forum last month. "All of this could have been avoided."  FULL STORY

CYFD Case Worker Accused Of Child Abuse

New Mexico- A case worker for the Children, Youth and Families Department has been charged with child abuse.

Justina Romero, 27, of Las Vegas, N.M., has been charged with three counts of child abuse. Romero is a case worker for the Children, Youth and Families Department

Court documents state that on Dec. 30, authorities found a large quantity of powder cocaine, crack cocaine , marijuana, drug paraphernalia and several firearms in Romero's home.

The complaint states Romero's three children -- ages 2, 5, and 11 -- had easy access to the guns and drugs.

Romero's husband -- Alex Romero, 30 -- was arrested and charged with cocaine and marijuana trafficking charges and child abuse.

Police also searched Alex Romero's car. At that time police, allegedly found cocaine on him.

Authorities also raided his place of business, where police say they found crack cocaine and marijuana ready for sale.

Justina Romero is on paid administrative leave from her case worker position while CYFD conducts an investigation. CYFD would not comment about the incident on camera.

CYFD spokesperson Romaine Serna said Justina Romero is a tenured employee who assists families with in-home services. (Or maybe not really)

Serna said CYFD has demonstrated that when allegations are serious, the agency has acted seriously and plans to do the same with this incident.

A court date for Justina Romero is pending. Her husband remains in custody on a $100,000 cash only bond.

Several months ago, CYFD fired its deputy director of Youth and Family Services, Mark Edwards, after investigators said Edwards admitted to having child pornography on his home computer.

Just a few weeks after Banita Jacks was sentenced to 120 years in prison for murdering her four daughters, the *other* completely horrifying area child abuse case of 2008 has its first sentencing news. Renee Bowman, the Maryland woman accused of killing two of her adopted daughters and stashing their bodies in a freezer, has been sentenced to 25 years for abusing her third, surviving daughter. Bowman still awaits trial for the murders of her other two daughters.

D.C. Child and Family Services Agency faces $10M budget hole

The D.C. Child and Family Services Agency is facing a budget hole of as much as $10 million after it failed to meet a Jan. 1 deadline to resume billing Medicaid for many of the services that the agency delivers, according to people familiar with the agency's problems.

CFSA had stopped seeking Medicaid reimbursements because the agency was mishandling millions of dollars in claims, but CFSA managers were supposed to have solved the problems by the end of 2009 and reopened a critical pipeline of federal money.

Instead, the agency's efforts have stalled at a time when local tax revenues are falling and demand for social services is rising.

In an e-mail Friday afternoon to CFSA staff, Director Roque Gerald said new guidelines from the federal government had delayed the agency's timetable for resuming claims to Medicaid.

The agency-wide message appeared intended to pre-empt news inquiries about the agency's troubles. "[Y]ou should anticipate extensive media attention to this issue from a range of viewpoints. I want you to hear our perspective from me first . . . ." Gerald said.

The overwhelming majority of children in the child welfare system are eligible to have some of their services covered by Medicaid, the federal-local health insurance program for the poor. But the District government, and in particular CFSA, has struggled to recoup the city's share of Medicaid dollars.

Suzanne Listro, 43 of 260 Stearns Road, was charged with the May 19, 2008, death of 7-month-old Michael Brown Jr.

After months of delay, her jury trial is slated to start at Rockville Superior Court at 10 a.m.

Listro’s Hartford attorney, Hubert Santos of Santos & Seeley, could not be reached for comment this morning.

Listro was charged July 16, 2008, with first-degree manslaughter and risk of injury to a minor. She pleaded not guilty to both charges in a December 2008 court appearance.

Listro had worked with DCF for 12 years and spent a year as a “children’s services consultant.” 

She was terminated from the department following the death of Brown.

According to DCF Commissioner Susan Hamilton, Brown was Listro’s first foster placement with the department.

Brown was in Listro’s care one week when he died from a “blunt traumatic head injury.”

According to court records, Listro said Brown’s injuries were sustained from “falling off the bed.”

Listro said Brown fell from the bed when she was ejecting a tape from the VCR in her bedroom and the boy began crying, according to the police report.

Court records state she told police Brown cried and screamed, but then stopped and went limp while she picked him up.

However, court documents show Dr. Ronald Gross of Hartford Hospital told police “the victim’s injury did not appear consistent with the reported fall.”

Gross was the physician who pronounced Brown dead at 9:55 p.m. the evening of May 19, 2008, after he was transported to Hartford for medical attention.

The Office of the Chief State’s Medical Examiner ruled the death a homicide.

As a result of the death of baby Brown, several state officials called for a “complete overhaul” of the DCF to ensure no more deaths or incidents occur.

Connecticut Attorney General Richard Blumenthal said in October 2008 the department needed to be broken up and sections need to be reassigned.

“At the core of DCF’s problems and our recommendations is a fatal dilemma,” said Blumenthal at the time, adding DCF currently hires private individuals for additional services for abused and neglected children.

Blumenthal said the department cannot both hire and regulate providers.

“Doing both presents an inherent, inevitable conflict of interest,” he said. “The agency cannot be both contractor and regulator.”

In a report released in May, it was determined Brown’s death may be attributed to procedural flaws in the DCF.

The report was compiled by the Child Welfare League of America, in collaboration with DCF and the Office of the Child Advocate.

The Child Welfare League is a national nonprofit group in Virginia dedicated to child welfare issues.

According to the report, it was discovered foster parent pre-training did not “adhere” to certain components of the department’s prescribed training curriculum.

In addition to improper training, previous claims of child neglect against Listro were lost in paperwork within the department. You bet your ass.  Absolutely normal procedure. 

During the investigation, it was discovered personnel responsible for licensing Listro as a foster parent were not aware of two previous “unsubstantiated” investigations connected to the care of Listro’s own child. Anybody believe that?

In addition to Listro coming under fire, the department is also being blamed for the death of Brown.

His parents sought in May 2009 to sue to department for wrongful death.

The notice of a wrongful-death claim — dated May 12 — was sent to James Smith, the state’s claim commissioner, by Louis Flynn Jr. of the Hartford law firm Brown, Paindiris and Scott on behalf of Michael Brown Sr. of East Hartford.

According to the notice, the claims for damages for the estate of Michael Brown Jr. are estimated to be $15 million.  CPS needs to be sued out of business for TRILLION$ in damages against American Families.

The rate of children aged 2 to 5 who are given antipsychotic medications has doubled in recent years, a new study has found.

Yet little is known about either the effectiveness or the safety of these powerful psychiatric medications in children this age, said researchers from Columbia University and Rutgers University, who looked at data on more than 1 million children with private health insurance.

“It is a worrisome trend, partly because very little is known about the short-term, let alone the long-term, safety of these drugs in this age group,” said study author Dr. Mark Olfson, a professor of clinical psychiatry at Columbia University in New York City. Prescribing antipsychotics to children in the upper range of that age span — ages 4 and 5 — is justifiable only in rare, intractable situations in which all other treatments, including family and psychological therapy, have been tried and are not working, Olfson said.

And it’s questionable whether 2- and 3-year-olds should ever be prescribed antipsychotics, Olfson said.

Liberals rightly criticize America’s high rate of incarceration. Claiming to be the freest country on Earth, the United States incarcerates a larger percentage of its population than Iran or Syria. Over two million people, or nearly one in 50 adults, excluding the elderly, are incarcerated, the highest proportion in the world. Some seven million Americans, or 3.2 percent, are under penal supervision.

Many are likely to be innocent. In The Tyranny of Good Intentions (2000), Paul Craig Roberts and Lawrence Stratton document how due process protections are routinely ignored, grand juries are neutered, frivolous prosecutions abound, and jury trials are increasingly rare. More recently, in Three Felonies a Day: How the Feds Target the Innocent (2009), Harvey Silverglate shows how federal prosecutors are criminalizing more and more of the population. Innocence projects — projects of “a national litigation and public policy organization dedicated to exonerating wrongfully convicted people through DNA testing” — attest that people are railroaded into prison. As we will see, incarcerations without trial are now routine.

The U.S. prison population has risen dramatically in the last four decades. Ideologically, the rise is invariably attributed to “law-and-order” conservatives, who indeed seldom deny their own role (or indifference). In fact, few conservatives understand what they are defending.

Conservatives who rightly decry “judicial activism” in civil law are often blind to the connected perversion of criminal justice. While a politicized judiciary does free the guilty, it also criminalizes the innocent.

But traditionalists upholding law and order were not an innovation of the 1970s. A newer and more militant force helped create the “carceral state.” In The Prison and the Gallows (2006), feminist scholar Marie Gottschalk points out that traditional conservatives were not the prime instigators, and blames “interest groups and social movements not usually associated with penal conservatism.” Yet she names only one: “the women’s movement.”

While America’s criminalization may have a number of contributing causes, it coincides precisely with the rise of organized feminism. “The women’s movement became a vanguard of conservative law-and-order politics,” Gottschalk writes. “Women’s organizations played a central role in the consolidation of this conservative victims’ rights movement that emerged in the 1970s.”

Gottschalk then twists her counterintuitive finding to condemn “conservatives” for the influx, portraying feminists as passive victims without responsibility. “Feminists prosecuting the war on rape and domestic violence” were somehow “captured and co-opted by the law-and-order agenda of politicians, state officials, and conservative groups.” Yet nothing indicates that feminists offered the slightest resistance to this political abduction.

Feminists, despite Gottschalk’s muted admission of guilt, did lead the charge toward wholesale incarceration. Feminist ideology has radicalized criminal justice and eroded centuries-old constitutional protections: New crimes have been created; old crimes have been redefined politically; the distinction between crime and private behavior has been erased; the presumption of innocence has been eliminated; false accusations go unpunished; patently innocent people are jailed without trial. “The new feminist jurisprudence hammers away at some of the most basic foundations of our criminal law system,” Michael Weiss and Cathy Young write in a Cato Institute paper. “Chief among them is the presumption that the accused is innocent until proven guilty.”  FULL STORY

Some 12 percent of minors held in government custody are sexually abused, and in some facilities the rate reaches a stunning one in three children, says a report released Thursday by the Bureau of Justice Statistics.

The first-ever National Survey of Youth in Custody found that no less than 10 percent of the 26,550 juveniles being held in detention facilities in the US are abused by staff at the facility, while another 2.6 percent report abuse at the hands of other inmates.

Among the facilities studied were six identified to have rates of sexual abuse as high as three in 10. According to the Associated Press, those six facilities are Pendleton Juvenile Correctional Facility in Indiana; Corsicana Residential Treatment Center in Texas; Backbone Mountain Youth Center in Swanton, Maryland; Samarkand Youth Development Center in Eagle Springs, North Carolina.; Cresson Secure Treatment Unit in Pennsylvania; and the Culpeper Juvenile Correctional Center, Long Term, in Mitchells, Virginia.

"The widespread sexual abuse of children in juvenile facilities shows that public officials either aren't paying attention or can't be bothered to do the right thing," said Jamie Fellner, senior counsel for Human Rights Watch. "The high rates of victimization are powerful testimony to the failure of governments to safeguard the boys and girls in their care."

The study was mandated by a 2003 law, the National Prison Rape Elimination Act, which also created the National Prison Rape Elimination Commission.  FULL STORY

Such offenders are in a better position to seduce and manipulate victims and escape responsibility.

...The most difficult case of all involves a subject who has an ideal occupation for any child molester: a therapist who specializes in treating troubled children. This offender need only sit in his office while society preselects the most vulnerable victims and brings them to him. Two recent analyses – one psychological, the other legal – may debunk lenient modern parenting the way the Climategate e-mail scandal has short circuited global warming alarmism.

A study entailing 2,600 interviews pertaining to corporal punishment, including the questioning of 179 teenagers about getting spanked and smacked by their parents, was conducted by Marjorie Gunnoe, professor of psychology at Calvin College in Grand Rapids, Michigan.

Gunnoe’s findings, announced this week: “The claims made for not spanking children fail to hold up. They are not consistent with the data.”

Those who were physically disciplined performed better than those who weren’t in a whole series of categories, including school grades, an optimistic outlook on life, the willingness to perform volunteer work, and the ambition to attend college, Gunnoe found. And they performed no worse than those who weren’t spanked in areas like early sexual activity, getting into fights, and becoming depressed. She found little difference between the sexes or races.

....Gunnoe’s findings are being largely ignored by the U.S. media, but made a splash in British newspapers. It is not the first time her work has been bypassed by the press. Her 1997 work showing that customary spanking reduced aggression also went largely unreported.

Nor is she alone in her conclusions. Dr. Diana Baumrind of the University of California, Berkeley and her teams of professional researchers over a decade conducted what is considered the most extensive and methodologically thorough child development study yet done. They examined 164 families, tracking their children from age four to 14. Baumrind found that spanking can be helpful in certain contexts and discovered “no evidence for unique detrimental effects of normative physical punishment.”

She also found that children who were never spanked tended to have behavioral problems, (which is what all the DOPING has been about) and were not more competent than their peers.

As in climate change, politicians all over the world seem out of touch with the most rigorous science regarding parental discipline. The newest research could constitute powerful ammunition to parents rights activists seeking to reverse the global trend of intrusive governments muscling themselves between the rod and the child.  FULL STORY

Guernsey mother sues state DHS over foster care decision

IOWA- A Guernsey mother filed a lawsuit Tuesday against the Iowa Department of Human Services for placing her 5-year-old daughter in foster care based on a false allegation and asks the court to prevent it from happening again.

Jessica Wilbur, 20, filed the lawsuit in Johnson County District Court, claiming Paul LaFauce, a DHS abuse investigator, and DHS Director Charles Krogmeier violated her constitutional rights by placing her child in foster care based on document signed by the child’s non-custodial father, Robert Nino of Marshalltown, a convicted sex offender.

According to a petition filed Nov. 13, Nino took the girl for a weekend visit in November, did not return her to her mother and filed a false sexual abuse complaint against Wilbur. Nino then signed a voluntary foster care placement agreement with the DHS, and the child spent two weeks in foster care.

The abuse allegation was deemed to be false, but the department refused to return the child until after an article about the case ran in The Gazette, said Natalie Cronk, Wilbur’s attorney.

Cronk said the DHS contacted Wilbur at that point and said her child would be returned if she signed a plan to assure the girl’s safety. The plan, Cronk said, had nothing to do with the initial allegations.

Cronk then went with Wilbur to the foster care home of Nino’s sister, who wasn’t a qualified foster parent, to take the child home after the DHS couldn’t produce an order granting authority to restrain or withhold the child from her mother.

The lawsuit contends the Johnson County DHS office has since retaliated against Wilbur by proceeding with a baseless investigation and has threatened additional action.

DHS spokesman Roger Munns declined to comment Tuesday.

The suit asks the court to declare the DHS policy under which Nino signed the girl away a violation of Iowa law and constitutional principles. It also asks for punitive damages against LaFauce.

Richard and Margie Cressy, homeschooling parents of four children who live in Glenn, New York, were assaulted and kidnapped by local tax-feeders for the supposed crime of educating their children at home without receiving the required benediction from the local high priest of the educrat cult.

That’s how this story should be reported. The court stenographers for Leviathan’s regional appendage described those events as follows:

“A Montgomery County couple has been arrested on child endangerment charges for failing to register their children with the school district as they were home-schooled, the Montgomery County Sheriff’s Office said Monday.”

Under the pernicious doctrine of parens patriae, the default assumption is that children belong to the State. Under that scheme parents (whether biological or adopted) are granted the highly conditional privilege of feeding, housing, and otherwise caring for children unless and until the State claims them as its own.

In the story broadcast by WGRB, Albany’s ABC affiliate, the parents are treated as entirely incidental to the matter of educating their own offspring. The epicene newsreader exudes incredulous disapproval as he observes that the Cresys “failed to register” their children with the school district seven years ago.

“How was this allowed to happen? Who should be held accountable?” demands the anchorperson, handing the baton to a correspondent who asks the local education commissar if these children “fell through the cracks.” The “news” clip is entitled “Homeschooled or Forgotten?” — conveying the message that children who are raised, educated, and cared for by parents without the State’s blessing are neglected by definition.

In classic totalitarian police state fashion, the Cressys were arrested on the basis of an anonymous tip.

“So who should be held accountable?” the correspondent-cum-prosecutor asks an unidentified police officer near the end of the clip.

“Well, the parents,” replies the officer, a tax-feeder of ample carriage. “It’s not the school’s fault; the schools are doing the right thing trying to get the parents to file the proper paperwork, which they have now.”

The “law” requires that certain forms be filled out and disfigured with specific official signatures. No actual crime was committed here, of course, but like the Vogons who populate Douglas Adams’ neo-Swiftian sci-fi novels — an interstellar race of  intellectually torpid, morbidly obese bureaucrats — the county mis-education establishment and its enforcers were willing to kill (if “necessary”) two parents and steal their children because the “necessary” paperwork hadn’t been filled out.

Somalia to Ratify CRC, US to Stand Alone

UNICEF announced on the 20th anniversary of the Convention on the Rights of the Child November 20 that Somalia’s transitional federal government (tfg) plans to ratify the Convention, leaving the United States as the lone hold-out among the UN’s member states.  According to BBC reports, the tfg only governs a portion of Mogadishu (the capital of Somalia) while pirates and Muslim militias rule the rest of the nation, but the tfg “is backed by the UN and African Union.”  So why would an impotent, geographically-challenged, UN-backed transitional government suddenly announce that it plans to ratify a treaty it is powerless to implement? The UN’s announcement is set to increase pressure on the United States to ratify this dangerous convention.

Somalia as a nation is known for its pirates and its child soldiers. Sometimes, we even hear about its child pirates.  The idea that the nation is suddenly joining “the good guys” as a signatory to the CRC is preposterous, but it is being set forth by proponents of the treaty. A new analysis from Harvard University, using H1N1 deaths in the U.S. in the spring and projecting likely outcomes for this fall, suggests that the swine flu “pandemic” has been oversold.

Some scoffed when President Barack Obama said part of the cost of health care reform could be covered by eliminating fraud in the system. But each arrest made by the federal Medicare Fraud Strike Force illuminates how extensive the bogus billing schemes can be. Rooting out that fraud is key to cutting health care costs.

Federal agents swooped into Detroit, Brooklyn and Miami recently to break up schemes the government said had defrauded Medicare of $61 million. They arrested 30 people, including doctors and nurses.

This month, the U.S. Department of Health and Human Services Office of Inspector General reported it suspected South Florida providers were fraudulently collecting Medicare reimbursement for treatment of home-bound diabetes patients that was either not delivered or was medically unnecessary. Statistics were the tip-off: In 2008, Miami-Dade accounted for more than half of the $1 billion Medicare paid nationally for home treatment of people with diabetes and related illnesses, yet the county has only 2 percent of the nation's qualifying diabetic patients. The federal government also stopped reimbursing a Miami psychiatrist who wrote nearly 97,000 prescriptions to Medicaid patients over a period of 18 months, nearly twice the number of the second-highest prescriber in Florida.

With providers under scrutiny in Miami-Dade, the Medicare Fraud Strike Force is expanding its reach to Tampa, where it has discovered similarly suspicious statistics. The strike force, created in 2007, claims to have targeted 257 people in a handful of cities who allegedly falsely billed Medicare for $600 million.

That's likely just the tip of the iceberg. Fraud at such a scale impacts the solvency of the Medicare system and enriches criminals with money that could be used to treat the sick. Stopping it is part of the solution to the country's health care crisis.  FULL STORY

Jeanne Giovannoni, a UCLA professor whose research helped expand understanding of the categories of child abuse and how social workers, law enforcement and community members respond to them, died Dec. 17 at Santa Monica UCLA Medical Center. She was 78.

The cause was lung cancer, said Ralph Hurtado, a longtime friend.

Giovannoni was a longtime professor in UCLA's School of Social Welfare and associate vice chancellor for faculty relations until her retirement in 1993. A prolific scholar, she was best known for "Defining Child Abuse" (1979), a widely cited book co-written with UCLA colleague Rosina M. Becerra.

That book "basically changed how we define child maltreatment," said Becerra, a UCLA professor and vice provost for faculty diversity. "She pulled it apart to say that there are many ways children are maltreated."

The book drew on interviews with professionals who work with child abuse victims and their families -- including pediatricians, social workers, law enforcement and attorneys -- and analysis of 949 cases of child abuse in four California counties. The authors defined child abuse as physical or sexual mistreatment as well as neglect stemming from poverty, family dysfunction and other conditions.

They also found that each group of professionals rated the seriousness of various types of child abuse differently. Police officers, for instance, tended to focus more on parental sexual behavior, while social workers were more concerned with emotional mistreatment. Giovannoni and Becerra also discovered that cultural background influenced people's perceptions of what constituted child abuseWhich is why so many allegations they make are bat crazy absurd.

Psychiatrist James S. Gordon, in a 1980 New York Times review, noted that the book was mainly of interest to scholars and child abuse investigators but that its findings about beliefs, attitudes and treatments were "of broad significance."  FULL STORY

Bryan Davies, 63, was branded a child molester after two girls claimed he sexually touched them.

The Senate HELP Committee staff circulated draft reauthorization language in early June 2009. The draft did not include the provision mandating appointment of a second person to provide legal representation. A letter was submitted to HELP Committee leadership on behalf of CCJ/COSCA. APHSA and NCSL also have a concern regarding a new unfunded mandate.

The legislation is on hold until health care reform legislation is resolved. The House is expected to defer action until after legislation is filed in the Senate."

GEORGETOWN, Del. – A pediatrition charged with sexually abusing his patients likely attacked more than 100 children at an office he had decked out with a merry-go-round and a ferris wheel, a state official said Wednesday.

.....America will go through a fundamental change in 2010 – guaranteed. Either it will be fundamentally transformed into a full-fledged socialist police state, then, ultimately, a communist police state, or those who still believe in freedom will do whatever it takes to overthrow the oligarchy that now rules over us.

If the Republicans, after winning back the House and Senate – or even coming close – continue to act like a branch of the Demopublican Party and ignore the Constitution, it most likely will bring into existence a third party (How about the Tea Party?) that would be the first such animal of the modern era that would have a legitimate shot at of winning the presidency in 2012.   

But, as I have so often pointed out, the caveat is that the fascist president and Congress may very well find a Chavezian reason to declare a state of emergency and "postpone" the 2012 presidential election. Regardless of whether that emergency is a total collapse of the U.S. economy or a terrorist attack, don't be fooled. New promise: Lawsuits to challenge 'Obamacare'

Obamacare, as critics have dubbed the president's plan to socialize health care, will be flooded with lawsuits if it ever becomes law, according to an organization that works to protect rights and liberties of Americans.

In an alert issued this week, Liberty Counsel, run by President Mathew Staver, promised his organization "is prepared to challenge the constitutionality of the bill since Congress has no authority to require every person to obtain insurance coverage and has no authority to fine employers who do not provide the coverage standards that are required in the bill."

"In addition," he warned, "the bill still requires citizens to pay a fine if they don't maintain insurance for themselves and their families."

The promise came just before the U.S. Senate approved its version of the health-care reform plan. The House has adopted a version that must be reconciled with the Senate's before moving to the president's desk. Among major sticking points are a government-run "option," as well as abortion funding, which has drawn strong opposition from the public.

But like demanding that everyone drive a blue car or watch a specific television network, the concept of mandatory health insurance set by the government just doesn't appear in the U.S. Constitution, Staver argues.

He told WND that if the plan gets to the point of being signed into law by Obama, "We will sue."

He said Liberty University will be a plaintiff along with other groups or individuals.   

"The thrust is that Congress lacks the power to force health care coverage on individuals, " he said. "It lacks the power to fine employers that do not have or provide health care coverage according to the mandates of the bill."  FULL STORY

My take on this is CPS is in full defense mode.  The DA will always take CPS' side and do his best to help cover the story up.  CPS does nothing but evil, all the time.  When they get caught in a real murder, they are in SERIOUS trouble.  It's what they call a "high risk case".  You cannot prevent murders from happening, and if you think you can, please watch the old movie "Minority Report".  CPS is a 100% fraud, all the time, everywhere.

In the continually harsh public discourse over the President’s proposals for federally-managed healthcare, the Big Government progressives in both the Democratic and the Republican parties have been trying to trick us.

These folks, who really want the government to care for us from cradle to grave, have been promoting the idea that health care is a right. In promoting that false premise, they have succeeded in moving the debate from WHETHER the feds should micro-manage health care to HOW the feds should micro-manage health care. This is a false premise, and we should reject it. Health care is not a right; it is a good, like food, like shelter, and like clothing.

What is a right? A right is a gift from God that extends from our humanity. Thinkers from St. Thomas Aquinas, to Thomas Jefferson, to the Rev. Dr. Martin Luther King, Jr., to Pope John Paul II have all argued that our rights are a natural part of our humanity. We own our bodies, thus we own the gifts that emanate from our bodies. So, our right to life, our right to develop our personalities, our right to think as we wish, to say what we think, to publish what we say, our right to worship or not worship, our right to travel, to defend ourselves, to use our own property as we see fit, our right to due process – fairness – from the government, and our right to be left alone, are all rights that stem from our humanity. These are natural rights that we are born with. The government doesn’t give them to us and the government doesn’t pay for them and the government can’t take them away, unless a jury finds that we have violated someone else’s rights.

What is a good? A good is something we want or need. In a sense, it is the opposite of a right. We have our rights from birth, but we need our parents when we are children and we need ourselves as adults to purchase the goods we require for existence. So, food is a good, shelter is a good, clothing is a good, education is a good, a car is a good, legal representation is a good, working out at a gym is a good, and access to health care is a good. Does the government give us goods? Well, sometimes it takes money from some of us and gives that money to others. You can call that taxation or you can call it theft; but you cannot call it a right.

A right stems from our humanity. A good is something you buy or someone else buys for you.  FULL STORY

Impostors Perform Medical Exam on Children

Indiana- An Evansville mother was apparently tricked into letting a pair of impostors perform an medical examination on her kids.

Police say the suspects made inappropriate contact with two small children living in the home. One impersonated a law enforcement officer and the other claimed to be an employee of the Department of Child Services.

The impostors have not been arrested and there could be more victims out there who are unaware of the deception. That's why the victims are speaking out. To protect identities faces have been blurred in the video and names are not being released.

The Indiana Department of Child Services had never seen anything like this before. "We found out this woman that came into our home doesn't even exist,” said the victims' mother.  FULL STORY and Video

Feds nab ACS staffers in subsidy scam

Three child care workers and two others were charged Wednesday with stealing $1.5 million meant for the city's most vulnerable kids and spending it on fancy cars, a pricey apartment and other goodies.

In charges leveled in Brooklyn and Manhattan, the feds accused the three Administration for Children's Services workers - and two foster care officials - of concocting three separate schemes to turn the child welfare agency into their private piggy bank.

Prosecutors said one of the accused used the money to buy a sleek black $84,000 BMW LI and a 2006 Range Rover and to pay $30,000 in rent for an apartment in a doorman building with a private garage.

The arrests amounted to another black eye for ACS. They came a day after "House of Horrors" mom Judith Leekin got 11 years in jail for swindling city and state agencies out of $1.68 million in adoption subsidies for 11 kids who were starved, handcuffed to crib rails and beaten with irons.  Read more
