INTRODUCTIONThe James Doherty Papers reflect Doherty's career as a legal professional, especially as assistant Public Defender (1956-1972/1986-1997) and as Public Defender (1972 -1986) of Cook County, Illinois. The collection includes Doherty's files for cases where he was defense attorney, as well administrative records of the Cook County Public Defender's Office. Doherty wrote extensively during his lifetime, and manuscripts and working papers for several books are included, two relating to cases where he was defense attorney.
The Papers also reflect Doherty's work as a lecturer on trial practice and procedure. Doherty taught courses and lectured at law schools in and around Chicago, and he was a Fellow of the National College of Criminal Defense Lawyers. His papers document these "extra professional" activities, and also included are the working papers for Ready For Trial Your Honor, a manual or handbook for trial lawyers. A copy of the published book is contained in the collection.
Doherty collected newspaper clippings, scholarly articles, legal decisions, etc., all pertaining to various legal issues and case precedents. These are scattered throughout the collection, and most form part of the series on professional activities (see below). Outside of his professional life, Doherty was a chaplain of the American Legion. The Papers include eulogies and other information pertaining to that aspect of his life. There are also segments of short stories authored by Doherty, and jokes and witticisms. Finally, the collection documents Doherty's personal life including correspondence, articles about health issues, and information about his family and home life.
I. Series & Descriptions
The James Doherty Papers are organized into four series: 1) Case Files, 2) Administrative Papers, 3) Professional Activities, and 4) Personal Papers.
Case Files: This Series consists of Doherty's personal files for cases where he acted as defense attorney, although not all the files in the series fall into that category. There are also files on case precedents, files on other cases that might have had an impact on (or better informed) Doherty's work, and finally cases of Doherty's colleagues and staff. It should be noted here that none of the files are necessarily complete, and they do not constitute the official record of the Cook County Public Defender's Office. None of the files breach client/lawyer confidentiality in that they do not contain inculpatory information.
The Case Files series is sub-divided into three distinct parts: 1) records of the Lyman Moore case, including manuscripts and working papers for Trial By Ambush, Doherty's book about the case (see below); 2) records of the Sammie Garrett case, including manuscripts and working papers for Anatomy of a Murder, a book about the Garrett case (see below); and 3) records pertaining to all other cases. The Moore and Garrett case files are separated from the other cases only because of their size. The Moore file, including the book papers and manuscripts, fills more than five (15" x 12.5" x 10") boxes, and the Garret case file and manuscript fills a complete box of the same size.
Three cases are of particular interest in the Series: Lyman Moore, Sammie Garrett,
and Richard Speck. Richard Speck was convicted and sentenced to death for the 1966
murder of eight student nurses. Doherty was part of the defense team that appealed
the sentence claiming that potential jurors who stated they were opposed to the death penalty were excluded from the jury. The Illinois State Supreme Court agreed, and Speck's death sentence was vacated in 1971. Speck was ultimately re-sentenced to 400 years in prison. Doherty's file on the Richard Speck case is rather small, but it includes briefs for the Illinois State Supreme Court, notes, and newspaper clippings. The Lyman Moore and Sammie Garrett case files are much more substantial, primarily because Doherty was the appellate attorney for both Moore and Garrett, and with regards to the Lyman Moore case file there is nearly thirty years of files including nearly a hundred letters between the two.In October of 1962 Lyman Moore was indicted for the murder of Bernie Zitek, a
Lansing, Illinois bartender. Moore was subsequently found guilty and sentenced to
death in 1964. In June of 1964 Doherty was appointed counsel on appeal for Moore.
Doherty argued that a key witness for the prosecution had mistakenly identified and
attributed a confession of guilt to Moore, and also that the police did not turn over all evidence in their possession favorable to the defense. Doherty also argued that the prosecution had, in the course of the trial, introduced evidence that was known to be irrelevant to the charge for which Moore was being tried. In 1972 Doherty pleaded Moore's case before the U.S. Supreme Court. The Supreme Court vacated Moore's death sentence in June of 1972, but in a five to four decision the Court affirmed Moore's conviction. He thereafter was sentenced to 60 to 100 years in prison.In November of 1969 Sammie Garrett was charged with the murder of Karen Thompson.
Garrett and Thompson (who was married) met while enrolled at Prairie State College in Chicago. An affair ensued, and one night after class the two went out together. That same night they rented a hotel room after they had been out drinking, smoking
marijuana, and consuming barbiturates. Sometime earlier that evening Garrett had come into possession of a shot gun. When Garrett awoke the next morning he saw the dead body of Karen Thompson on the floor. There was a shot-gun wound in her head.
Garrett also found a suicide note from Thompson, but when he notified the police of
her death he was charged with her murder.At Garrett's trial a coroner testified that Thompson's death was caused by a gun shot wound from a gun that was at least four feet away from Thompson when it was fired. And despite testimony by Thompson's husband that she had been suicidal in the weeks leading up to her death, Garrett was found guilty and sentenced to life in prison.
Doherty took Garrett's case on appeal, and Thompson's body was exhumed for a re-examination of the gun wound to her head. Expert forensics witnesses were called in, and new evidence proved that the bullet that killed her entered her head through
her mouth, and not from a distance of four feet. Garret's conviction was subsequently overturned, but only after he had spent five years in prison.
Administrative Papers: These papers document Doherty's work as a public administrator and manager of the Cook County Public Defenders Office. The series includes records related to his work for the County outside of the courtroom. Included are memos and letters, budget and personnel information, and articles and newspaper clippings about his office as well as other defender offices. A good portion of the series includes the papers belonging to Doherty's "Disparity of Pay" investigation. In an attempt to garner more financial support and human resources for his department, Doherty gathered together statistical, budget, and salary information, comparing his department to other similar departments throughout the country.
Professional Activities: This is a large and encompassing series covering Doherty's professional life outside of the Cook County Public Defender's Office. Doherty was a prolific writer, scholar, and lecturer. He wrote and collected information about a multitude of legal issues. Areas of special interest include the components of a criminal trial and criminal appeals, forensics, and constitutional issues. There are articles, essays, court opinions, and other papers all relating to these issues as well as others not mentioned here. Some of the material may have been gathered by Doherty either for use in the classroom or in order to write Ready For Trial Your Honor, a "trial lawyers manual." The series also contains materials relating to several professional associations, particularly the National College of Criminal Defense and the National Association of Criminal Defense Lawyers. There is also information pertaining to a number of conferences and seminars attended by Doherty.
Personal: These papers document Doherty's personal and non-professional life. Included is information about his work as a chaplain for the American Legion, articles and information on veteran's affairs, personal health and financial information, and family life.
II. Size
Twelve Linear Feet / The collection fills eleven archival storage boxes, and there are two boxes that contain Doherty's awards, plaques, and other memorabilia.
III. RANGE
1960s-1990s
James J. Doherty was born in Belfast (Northern) Ireland in 1920. At a young age he immigrated with his family to the United States and they settled in Chicago. After high school he followed in his father's footsteps and went to work for the Central Illinois Railroad. Convinced by his Railroad co-workers to pursue a career in law, Doherty was graduated from the DePaul University School of Law in 1950, although he continued to work part-time for the Railroad for many more years.
In 1956 Doherty joined the Cook County Public Defender's Office as an assistant public defender in the appeals division. From 1972 to 1986 Doherty served as chief Public Defender of Cook County. And from 1986 to 1997, when he retired, he served as head of the appellate division.
Doherty is known for having pioneered the concept that the police and prosecution are obliged to turn over evidence favorable to the defense. He also advocated the concept that potential jurors should not be excluded from a jury because they are opposed to the death penalty. He argued or helped prepare briefs for several cases before the United States Supreme Court, using these legal issues as the basis for his appeals. Doherty was staunchly opposed to the death penalty and was successful in having Lyman Moore's death sentence repealed.
The James Doherty papers reveal a spiritual person of Christian faith. He believed in serving people in need, and lived by his own "Defender's Credo," that hung on his wall in his office where he worked for more than forty years.
