SERVICES TO FAMILIES IN CRISIS - AS MANDATED BY 42 U.S.C. § 671 (a) (15) and 672 (a) (1)

An agency cannot be reimbursed for the cost of a child's out-of-home care unless the
reasonable efforts requirement is met.  Kin are supposed to be the preferred placement.

Permanent termination of parental rights has been described as "the family law equivalent of the death penalty in a criminal case" in re Smith (1991), 77 Ohio App.3d 1, 16, 601 N.E.2d 45, 54. Therefore, parents "must be afforded every procedural and substantive protection the law allows."

"No government and no court should be allowed to take a child from a parent unless there is a very, very, very good reason.  Because to have a child ripped from you, it's the same as a child dying. It's absolutely uncivilized, barbaric and devastating for any parent. It's not uncommon for these people to suffer depressive breakdowns."-- Hazel McBride, a contemporary suicide researcher and psychotherapist  CPS is COUNTING ON IT.  They use that as "evidence" for the Character Assassination.

It also may be a ploy by those cynical and unscrupulous enough to exploit children for their own purposes. This is likely to be remembered as one of the most diabolical perversions of governmental power in our history, a time when we allowed children to be used and abused by fast-talking government officials and paid for it with our families, our social order and our constitutional rights.-- STEPHEN BASKERVILLE (in about 2000)

Senator Dole on February 24, 1995, stood before the Senate and condemned the UN Convention on the Rights of the Child. ..... He stated,

Mr. President, in the past several days, I have received thousands of calls from all over the country in opposition to this Convention. My office has not received one call for it. These contacts have raised many serious problems that need to be examined. They have raised questions about Articles 13, 14, and 15, which grant children the freedom of speech, thought, conscience, religion, association, and assembly. Could these articles be interpreted to limit the ability of parents to decide for themselves how best to raise their children? Should U.S. citizens be subject to some sort of international committee that enforces compliance with Article 28(2) which states: “State Parties shall take all appropriate measures to ensure that school discipline is administered in a manner consistent with the child’s human dignity and in conformity with the present Convention?”

Under Article VI of the Constitution, Senate ratification of this Treaty would make it the supreme law of the land. Would the Convention then supersede Federal and State laws? What would the effect of the convention be on the Tenth Amendment? Is the convention merely a symbolic exercise, or will it actually require the United States to take actions? These are sincere questions from sincere people. They deserve answers ...

I also believe we in the United States have made significant progress in protecting the rights of the child through Federal, State, and local laws. These laws are better equipped to deal with the varying challenges posed by the issue of child rights. If there is one thing this election taught us, it is the need to get excessive government out of people’s lives. This applies to the Federal government, and it certainly applies to the multilateral, quasi-government that is the U.N. (Congressional Record, page S-3081).  MUST SEE FULL STORY

..."In a forceful opinion, US District Judge James G. Carr wrote: “Despite the Defendants’ exaggerated view of their powers, the Fourth Amendment applies to them, as it does to all other officers and agents of the state whose requests to enter, however benign or well-intentioned, are met by a closed door.  There is...no social worker exception to the strictures of the Fourth Amendment.  ...Any agency that expects to send its employees routinely into private homes has a fundamental obligation to ensure that those employees understand the constitutional limits on their authority.”

The caseworkers in the Walsh case admitted they had never been taught anything about the Fourth Amendment or search warrants. 

The court further ruled that the police did not have probable cause to detain, frisk, and threaten to arrest Walsh, since he was not breaking any law but merely asserting his “fundamental right to be left alone.”

Foster Care vs. Keeping Families Together: The Definitive Study

NCCPR long has argued that many children now trapped in foster care would be far better off if they had remained with their own families and those families had been given the right kinds of help.

Turns out that’s not quite right.

In fact, many children now trapped in foster care would be far better off if they remained with their own families even if those families got only the typical help (which tends to be little help, wrong help, or no help) commonly offered by child welfare agencies.

That’s the message from the largest study ever undertaken to compare the impact on children of foster care versus keeping comparably maltreated children with their own families. The study was the subject of a front-page story in USA Today. 

...The buzzword in child welfare lately is “evidence-based.” What that really means is: How dare proponents of any new, innovative approach to child welfare expect to get funding if they can’t dot every i and cross every t on evaluations proving the innovation’s efficacy beyond a shadow of a doubt? Old, non-innovative programs, however, are not held to this standard. If they were, child welfare would be turned upside down by the results of this new study.

Because now, more than ever, the evidence is in.

A new proposal for custody in dependency cases

I have a suggestion that I think goes to the heart of the problem. Specifically, I believe the state should not have custody of children. And I believe their having custody is what grants them the virtually unfettered power they hold over parents. After explaining my solution, I have attached part of a brief I wrote regarding what I believe is  the proper place of CPS under current law. Feel free to forward my ideas to others who may be interested in the problems surrounding CPS cases.

Imagine your terror and panic: you are awakened by an armed SWAT team in the middle of the night, demanding to be let into your home to take your children away. The grim-faced agents show you no warrant, no court order, and no mercy. They give you no reason for their presence, other than having received an unspecified report about child abuse. They bark commands and menace you and your children with their weapons. The children are taken out of your home screaming, shoved into cars, and whisked away into the night.

This is not a Soviet-era movie script, but a reality in thousands of homes in the United States every year, courtesy of state child protective services agencies.


The least reported and understood social crisis of our time is the vast new police state run by these state social services agencies, which are generically referred to as “child protective services,” or CPS.  MUST SEE FULL STORY

Audio from NPR.org (National Public Radio) about the utter lack of science which psychologists use when determining child custody in those costly psychological evaluations.  Absolutely no published scientific studies published on the outcomes of these evals.  It's all bogus.

Child Protection and Child Outcomes: Measuring the Effects of Foster Care American Economic Review 97(5). December 2007: 1583-1610. The child welfare system investigates over 2 million children each year for parental abuse or neglect, yet little is known about the effects of removing children from home and placing them in foster care. Long-term outcomes are rarely observed, and children placed in foster care likely differ from those not placed, making comparisons difficult. This paper uses the removal tendency of investigators as an instrumental variable to identify causal effects of foster care placement on a range of outcomes for school-age children and youth. A rotational assignment process effectively randomizes families to these investigators. The results suggest that children assigned to investigators with higher removal rates are more likely to be placed in foster care themselves, and they have higher delinquency rates, teen birth rates, and lower earnings. Large marginal treatment effect estimates suggest caution in the interpretation, but the results suggest that children on the margin of placement tend to have better outcomes when they remain at home, especially for older children.

What has happened to the American family? It doesn’t exist, anymore. Oh, we have something we like to call “family”, often times living beneath the same roof, but it’s not family… not in the true sense of the word.

America has redefined Family until we have defined it out of existence. I think that was intentional. Our socialist brothers and sisters, on the left, want to control this country and to do that they must destroy the basic building blocks of this republic and reassemble those blocks to suit themselves. The single most important building block of any nation is her families. Destroy that and you can easily lay claim to a nation’s soul. And that is exactly what has happened.
